LIFETIME LIMITED WARRANTY

FOR CALIBER GAMES ORIGINAL AND CLASSIC PRODUCTS

If you don't want to read the legal jargon.

We stand behind our products, and if something happens during normal use that comes from defects in the materials or workmanship we want to make it right and send you a new product or replacement part. When we say “our products” we mean the products you find in our “Originals” and “Classics” section. The products in our “Brands you love” section will be subject to their specific manufacturer warranties.

Here are some examples of things we will cover in our lifetime limited warranty:

• If you throw one of our soft-touch balls at your TowerBall and it cracks one of the TowerBall panels while its constructed. (this should never happen).
• If any of your TowerBall panels break or crack during normal use.
• If you throw one of your HOKU stars at the HOKU game board and it breaks the star or the game board. (this should never happen).

Here are some examples of things we will NOT cover in our lifetime limited warranty:

• If you incorrectly assemble your TowerBall, and the use of extreme force causes one of the male connection points to break off. Please read the provided TowerBall game guide or watch our assembly video to see how to properly assemble and disassemble.
• If you throw your assembled TowerBall in the air, and it lands and breaks, that is not considered normal use.
• If someone falls on the TowerBall and breaks it.
• If you throw the HOKU gameboard and it breaks - That is not a part of standard gameplay and therefore is not considered normal use.

To put it plainly, anything that causes one of our products to break that is outside of normal gameplay we will NOT cover in our lifetime limited warranty.

THIS LIFETIME LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO HAVE OTHER RIGHTS, WHICH VARY FROM STATE TO STATE. 

THE LIFETIME LIMITED WARRANTY CAN ALSO BE FOUND ONLINE AT https://CALIBERGAMES.com/warranty AND IN THE DOCUMENTATION WE PROVIDE WITH THE PRODUCT.

WE WARRANT THAT DURING THE WARRANTY PERIOD, THE PRODUCT WILL BE FREE FROM DEFECTS IN MATERIALS AND WORKMANSHIP.

WE LIMIT THE DURATION AND REMEDIES OF ALL IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE TO THE DURATION OF THIS EXPRESS LIFETIME LIMITED WARRANTY. 

SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

OUR RESPONSIBILITY FOR DEFECTIVE GOODS IS LIMITED TO REPAIR, REPLACEMENT, OR REFUND AS DESCRIBED BELOW IN THIS WARRANTY STATEMENT. 

 

WHO MAY USE THIS WARRANTY?

Caliber Games LLC located at address 4653 Nall Rd, Farmers Branch Texas 75244 (“we”) extend this LIFETIME LIMITED WARRANTY only to the consumer who originally purchased the product (“you”). It does not extend to any subsequent owner or other transferee of the product.

WHAT DOES THIS WARRANTY COVER?

This LIFETIME LIMITED WARRANTY covers defects in materials and workmanship of Caliber Games original and classic products (the “product”) for the Warranty Period as defined below.

WHAT DOES THIS WARRANTY NOT COVER?

This LIFETIME LIMITED WARRANTY does not cover any damage due to: (a) transportation; (b) storage; (c) improper use; (d) failure to follow the product instructions or to perform any preventive maintenance; (e) modifications; (f) unauthorized repair; (g) normal wear and tear; or (h) external causes such as accidents, abuse, or other actions or events beyond our reasonable control.

WHAT IS THE PERIOD OF COVERAGE?

This LIFETIME LIMITED WARRANTY starts on the date of your purchase and lasts for up to 10 years (the lifetime duration of the product) (the “Warranty Period”). The Warranty Period is not extended if we repair or replace the product. We may change the availability of this LIFETIME LIMITED WARRANTY at our discretion, but any changes will not be retroactive.

WHAT ARE YOUR REMEDIES UNDER THIS WARRANTY?

With respect to any defective product during the Warranty Period, we will, in our sole discretion, either: (a) repair or replace such product (or the defective part) free of charge or (b) refund the purchase price of such product. We will also pay for shipping and handling fees to return the repaired or replacement product to you if we elect to repair or replace the defective product.

HOW DO YOU OBTAIN WARRANTY SERVICE?

To obtain warranty service, you must complete and submit to us a warranty form available at https://calibergames.com/warranty/form during the Warranty Period. The warranty form must be completed properly, in full, and is only deemed effective upon our receipt and acceptance of the same.

LIMITATION OF LIABILITY

THE REMEDIES DESCRIBED ABOVE ARE YOUR SOLE AND EXCLUSIVE REMEDIES AND OUR ENTIRE LIABILITY FOR ANY BREACH OF THIS LIFETIME LIMITED WARRANTY. OUR LIABILITY SHALL UNDER NO CIRCUMSTANCES EXCEED THE ACTUAL AMOUNT PAID BY YOU FOR THE DEFECTIVE PRODUCT, NOR SHALL WE UNDER ANY CIRCUMSTANCES BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES OR LOSSES, WHETHER DIRECT OR INDIRECT.

SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

 WHAT CAN YOU DO IN CASE OF A DISPUTE WITH US? 

The following informal dispute resolution procedure is available to you if you believe that we have not performed our obligations under this LIFETIME LIMITED WARRANTY: Please see Section 12 of our Terms and Conditions available online at calibergames.com/terms for our Dispute Resolution Procedures, which is incorporated by reference as if fully set forth herein.

You acknowledge and understand that YOU AND CALIBER GAMES LLC ARE AGREEING TO GIVE UP ANY RIGHTS TO LITIGATE CLAIMS IN A COURT OR BEFORE A JURY, OR TO PARTICIPATE IN A CLASS ACTION OR REPRESENTATIVE ACTION WITH RESPECT TO A CLAIM. OTHER RIGHTS THAT YOU WOULD HAVE IF YOU WENT TO COURT MAY ALSO BE UNAVAILABLE OR MAY BE LIMITED IN ARBITRATION.
